1. Acceptance of Terms

By accessing or purchasing products or services from Pleb.Works (“we,” “us,” or “our”), you (“you,” “customer,” or “user”) agree to be legally bound by these Terms of Service (“Terms”), our Privacy Policy, and all applicable laws and regulations. If you do not agree with any part of these Terms, please do not use our website or purchase our products.

2. Eligibility & Legal Use

You confirm that you are at least 18 years old and have the legal capacity to enter into binding contracts under the laws of your jurisdiction. You agree to use our products and services only for lawful purposes and in compliance with all applicable local, state, and federal laws, including but not limited to those of the United States and your place of residence.

3. Anti-Money Laundering (AML) Compliance

Pleb.Works is committed to complying with all applicable anti-money laundering laws and regulations. Orders may be subject to review and approval through AML screening procedures. We reserve the right to decline or cancel any order that we reasonably believe violates AML laws or other applicable regulations. You represent and warrant that you will not use our products or services for illegal activities, including but not limited to money laundering, terrorist financing, or fraud.

4. Products and Services

We sell Bitcoin mining hardware and related goods. Product availability is subject to change without notice. Product specifications, pricing, and descriptions are subject to change at our sole discretion.

Beta Devices & Early Tester Acknowledgment

Some of the products offered by Pleb.Works are in beta and experimental stages. By purchasing or using these beta devices, you agree to serve as an early beta tester. You acknowledge that beta devices may include bugs, incomplete features, or performance limitations, and understand that they may be modified, updated, or discontinued at any time without prior notice.

Beta Devices – Limited Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PLEB.WORKS SHALL NOT BE LIABLE FOR ANY DAMAGES, LOSSES, OR EXPENSES ARISING FROM YOUR USE OF BETA DEVICES, INCLUDING BUT NOT LIMITED TO HARDWARE FAILURES, SOFTWARE BUGS, OR INCOMPLETE FUNCTIONALITIES. YOU ASSUME ALL RISKS ASSOCIATED WITH BETA PRODUCTS, AND YOUR SOLE REMEDY SHALL BE THE PURCHASE PRICE PAID FOR THE BETA DEVICE.

5. Cryptocurrency Disclaimer

Pleb.Works does not sell cryptocurrency, does not promise or guarantee mining profitability, and does not provide financial, investment, or legal advice. Your use of our products and services is at your sole risk, and you acknowledge the inherent risks involved in cryptocurrency mining.

6. Order Fulfillment, Availability & Shipping

We currently ship only within the United States. It is your responsibility to provide accurate and secure shipping information. We are not liable for delays or lost shipments caused by incorrect or incomplete information provided by you.

7. Pricing & Payment

All prices are listed in U.S. dollars (USD). Payments made via Bitcoin or any other cryptocurrency are final and irreversible. No refunds or chargebacks will be accepted for cryptocurrency payments.

7.a Payment Processing

All Bitcoin payments on Pleb.Works are processed exclusively through our self-hosted BTCPay Server payment processor. While we strive to maintain uninterrupted and secure payment processing, we do not guarantee the availability, security, or performance of BTCPay Server or the Bitcoin network. You acknowledge that payment confirmation times, transaction fees, and network conditions are outside of our control. Pleb.Works shall not be liable for any delays, errors, or losses related to payment processing through BTCPay Server.

8. Returns & Refunds

All sales are final. Returns will only be accepted for items that are dead-on-arrival (DOA) and reported within 14 days of delivery. Proof of defect and authorization from Pleb.Works support is required for all returns.

9. Warranty

Pleb.Works provides no warranty on any products. Any manufacturer warranties apply and must be claimed directly from the manufacturer. We disclaim all other warranties, express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PLEB.WORKS, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE OUR PRODUCTS OR SERVICES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR DAMAGE TO PROPERTY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL PLEB.WORKS’ TOTAL AGGREGATE LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

YOU EXPRESSLY ACKNOWLEDGE THAT YOUR USE OF PLEB.WORKS PRODUCTS AND SERVICES IS AT YOUR SOLE RISK.

11. Assumption of Risk

You acknowledge and accept that cryptocurrency mining carries financial and operational risks, including hardware failure, software issues, fluctuating mining difficulty, and market volatility. You agree that you bear sole responsibility for any losses incurred.

12. User Conduct

You agree not to use our products or services for any illegal, fraudulent, or unauthorized purposes. You must comply with all applicable laws in your use of our site and products.

13. Export & Sanctions Compliance

You may not export, re-export, or transfer any products purchased from Pleb.Works to any country, individual, or entity subject to U.S. embargoes, sanctions, or export restrictions.

14. No Guarantee of Compatibility

You are solely responsible for verifying that any product you purchase is compatible with your power supply, firmware, software, and intended use case.

15. Disclaimer of Warranties

PLEB.WORKS PROVIDES ALL PRODUCTS AND SERVICES “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

16. Force Majeure

PLEB.WORKS SHALL NOT BE LIABLE FOR ANY FAILURE OR DELAY IN PERFORMANCE RESULTING FROM CAUSES BEYOND OUR REASONABLE CONTROL, INCLUDING BUT NOT LIMITED TO NATURAL DISASTERS, WAR, TERRORISM, LABOR DISPUTES, GOVERNMENT ACTIONS, OR SUPPLY CHAIN INTERRUPTIONS.

17. Indemnification

You agree to indemnify, defend, and hold harmless Pleb.Works and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your violation of these Terms or your misuse of our products or services.

18. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pleb.Works regarding your use of our site and purchase of products and supersede all prior agreements or understandings.

20. Dispute Resolution & Jurisdiction

Any dispute arising from or related to these Terms or your use of Pleb.Works shall be resolved exclusively by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules.

The arbitration will be held in Missouri, USA. Both parties waive any right to a jury trial and to participate in class actions or representative actions.

These Terms shall be governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict of law principles.

21. Changes to Terms

Pleb.Works reserves the right to modify these Terms at any time. Updated Terms will be posted on this website with a revised “Last Updated” date. Continued use of our services after such changes constitutes acceptance of the new Terms.

23. No Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized Pleb.Works representative.

24. Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may freely assign or transfer these Terms without restriction.

25. Headings

Headings are for reference purposes only and do not limit the scope or extent of such section.

26. Survival

Any provisions that by their nature should survive termination of these Terms shall survive, including but not limited to disclaimers, indemnification obligations, and limitations of liability.

27. Electronic Communications

By using our services, you consent to receive electronic communications from us to your email address or via posted notices on the site. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.

28. Third-Party Links & Content

Our site may contain links to third-party websites, services, or content (“Third-Party Content”). We do not control, endorse, or assume responsibility for Third-Party Content, and you access it at your own risk.

29. Time Limit on Claims

You agree that any claim arising out of or related to these Terms or your use of our products or services must be filed within one (1) year after such claim arose or be forever barred.

1. Flashing Services & Optional Software Installation

Flashing of firmware and pre-loading of Bitcoin Core, ckpool, or any other software is optional and not included by default. To request flashing or software installation, email support@pleb.works before or within 14 days of purchase. Such services may incur additional fees.

2. Pre-Installed Software: Bitcoin Core & ckpool

Upon explicit request, Devices may ship with Bitcoin Core and ckpool pre-installed and configured. You agree to use these under their open-source licenses (MIT for Bitcoin Core; see ckpool’s LICENSE). We bundle all original license texts and copyright notices.

You are solely responsible for applying future updates, patches, and configuration changes. pleb.works does not auto-update or remotely manage any software post-delivery. Devices and requested software are provided “as-is,” and we disclaim all warranties regarding performance, uptime, or compatibility.

3. Post-Sale Maintenance & Security

All sales are final. Once your Device is delivered, pleb.works has fulfilled its obligations. We do not provide on-site support, remote management, or automatic updates.

You alone must install all future software updates and patches, monitor performance and connectivity, and secure your Device (network setup, physical access, key storage). pleb.works disclaims all liability for unauthorized access, stolen funds, data breaches, or any damage arising from your failure to maintain or secure the Device.

Release & Acknowledgment

By accessing or using Pleb.Works’ website or services, you acknowledge that Pleb.Works and its developers, engineers, administrators, and team members (collectively “Pleb.Works”) have acted and continue to act in good faith and to the best of their honest ability in providing a Bitcoin-only service.

You further agree that all statements, terms, and policies are provided “as-is,” and that if any provision is held invalid or unenforceable, the remainder shall stay in full force and effect.

To the fullest extent permitted by applicable law, you hereby unconditionally release, waive, and forever discharge Pleb.Works and its affiliates, officers, directors, employees, agents, successors, and assigns from any and all claims, demands, liabilities, damages, costs, or expenses (including attorneys’ fees) arising out of or relating in any way to your use of the website or services or to any statements, omissions, or inaccuracies in these Terms or Privacy Policy, whether based on contract, tort, strict liability, or any other legal theory.
